Purpose and service owner
This document sets out the terms under which the service owner provides the meo67 service (the “Service”) to individuals or legal entities that sign up for it (the “Customer”).
The owner of the Service is:
- Company name: Encinacorba Sales Consulting Co., Ltd.
- Registration number: 0845567007267
- Registered address: 53/530 Pruksa 20 Village, Moo 2, Khu Khot Sub-district, Lam Luk Ka District, Pathum Thani 12130, Thailand
- Representative: Adrian Gasca Sancho (Director)
- Contact email: soporte@meo67.com
If you disagree with any of these terms, do not create an account or use the Service. Use of the Service after any changes to these terms constitutes acceptance of them (see section 11).
Definitions
- Customer: the individual or legal entity that owns the account and subscribes to the Service to manage one or more properties. Team members or subusers invited by the Customer act under the Customer's account and responsibility.
- Property or unit: each apartment, house, villa, room or other accommodation unit that the Customer adds to the Service and lists on one or more sales channels.
- Sales channel: a platform or online travel agency (OTA), booking engine or other website through which the Customer markets their properties and receives bookings.
- Connectivity provider: an independent third party, certified by sales channels, through which the Service exchanges availability, rates, restrictions, bookings and messages with those channels.
- Guest: a person who books or stays at a Customer's property and whose data reaches the Service through a sales channel or manual entry by the Customer.
- Account: the Customer's private space in the Service, identified by their email address and protected by credentials.
Signup and account
To create an account, you must be of legal age and have legal capacity to enter into a contract. If you act on behalf of a company, you declare that you are authorised to bind it to these terms.
The information you provide at signup and while using the Service must be truthful, complete and up to date. The service owner may suspend or close accounts created using false information or third-party information without their consent.
You are responsible for keeping your credentials confidential and for all activity carried out through your account, including activity by team members you invite. If you suspect unauthorised access, change your password and notify us immediately at soporte@meo67.com.
Each Customer has one account. You may not transfer, sell or share the account with third parties unconnected with managing your properties.
Service description
From a single dashboard, the Service enables the Customer to:
- publish and keep their properties' availability, rates and restrictions (minimum stay, closures, etc.) synced across the sales channels they connect;
- receive bookings, amendments and cancellations from those channels in the Service and display them in a unified calendar;
- receive and reply to guest messages that channels make available to the Customer, and optionally activate other messaging channels;
- manage their properties' operational information (property details, team, tasks, templates) and booking data.
Connectivity. Data exchange with sales channels is provided through one or more third-party connectivity providers. By connecting a channel, the Customer authorises the service owner to act on their behalf with the connectivity provider and the channel for that purpose. Each channel's availability, features and syncing times depend on the channel's own API and the connectivity provider, and may change without the service owner's involvement.
Relationship with channels and guests. The contractual relationship with each sales channel (commissions, cancellation policies, content requirements, penalties) is exclusively between the Customer and the channel and is governed by that channel's terms. The service owner is not a party to the accommodation contract between the Customer and the guest and does not take part in collecting booking payments, unless the Customer expressly activates a payment collection feature.
The service owner may add, modify or withdraw Service features to improve it or adapt it to channel changes, provided this does not substantially reduce the subscribed service.
Launch phase and paid plans
Launch phase. During meo67's launch phase, creating an account is free: no payment method is requested and no charge is made. Some Service features may not yet be available and will be activated progressively.
Paid plans. A paid plan is only activated if you expressly subscribe to it. Before subscribing, you will be shown the price, applicable taxes, duration, renewal, cancellation and refund terms, including, where applicable, the commercial guarantee published on meo67.com. A free account never converts to a paid plan automatically.
Customer obligations
The Customer agrees to:
- keep bookings, blocks and calendars up to date in the Service and review the unified calendar regularly, especially after connecting a channel, adding a unit or changing a mapping;
- complete and verify the mapping of each property and rate type to its corresponding listing on each sales channel, and check that published availability and rates are as intended;
- correctly configure rates, restrictions, currencies and taxes, and review the result on the channels themselves;
- comply with the terms of use, policies and content rules of each sales channel and connectivity provider;
- comply with regulations applicable to their activity (tourism licences and registrations, guest registration, tax obligations, protection of guests' personal data);
- not use the Service for unlawful purposes, to send unsolicited communications, or to access, extract or interfere with third-party data or systems; and not reverse engineer or resell the Service without written authorisation;
- keep their contact and billing information up to date and respond to the service owner's communications about the Service.
Limitation of liability
Service “as is”. The Service is provided with reasonable effort and the care expected of a cloud software provider, but without any guarantee of uninterrupted availability, freedom from errors or specific commercial results. Interruptions may occur due to maintenance, technical incidents or causes beyond the service owner's control.
Exclusions. To the fullest extent permitted by law, the service owner is not liable for overselling (overbookings), cancellations, penalties, guest claims or loss of revenue resulting from:
- bookings, blocks or changes not entered into the Service or entered late;
- incomplete or incorrect mappings of properties, room types or rates;
- rates, restrictions, currencies or taxes incorrectly configured by the Customer;
- outages, delays, errors, limits or changes in the APIs of sales channels or the connectivity provider, as well as channel decisions (listing suspension, visibility changes, new requirements);
- compromised credentials or account use by people authorised by the Customer;
- force majeure or events beyond the service owner's reasonable control.
Cap. The service owner's total liability to the Customer for any cause related to the Service is limited to the fees actually paid by the Customer in the twelve (12) months before the event giving rise to the claim. Under no circumstances will the service owner be liable for lost profits, loss of business, reputation or data, or indirect or consequential damages.
Support. Support is provided by email and through the channels indicated in the application, with responses on business days and within a reasonable time according to severity. Issues originating with the connectivity provider or a sales channel are referred to their support teams and remain subject to their own resolution times, over which the service owner has no control.
Nothing above excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from wilful misconduct or personal injury.
Intellectual property
The software, meo67 brand, design, texts, databases and other elements of the Service belong to the service owner or its licensors and are protected by intellectual and industrial property legislation. These terms transfer no rights in them, except for the licence to use them described below.
For the duration of the relationship, the service owner grants the Customer a limited, non-exclusive, non-transferable and revocable licence to access and use the Service to manage their properties in accordance with these terms.
Data, texts, photos and other content that the Customer enters into the Service belong and continue to belong to the Customer, who warrants that they have the right to use them. The Customer grants the service owner the licence necessary to host, process, transmit to sales channels and the connectivity provider, and display that content, solely to provide the Service.
Suggestions or feedback the Customer provides about the Service may be freely used by the service owner to improve it, with no obligation to provide compensation.
Suspension and account closure
Suspension. The service owner may suspend access to all or part of the account, with prior notice where possible, in the event of non-payment, breach of these terms or a channel's rules, use that puts the Service's security or stability at risk, or a request from an authority. During suspension, data is retained, but channel syncing may be interrupted.
End of the free phase. If the service owner decides to end the free launch phase, it will notify you by email at least 30 days in advance. If you do not subscribe to a plan, the account and its data will be retained for a reasonable period to allow subscription or export, then deleted in accordance with the privacy policy.
Account closure by the Customer. You can close your account at any time through account settings or by writing to soporte@meo67.com. Before doing so, we recommend exporting any data you need and disconnecting the channels, since after closure the units are removed from the connectivity provider and data is deleted within the periods stated in the privacy policy.
Termination by the service owner. The service owner may terminate the relationship with 30 days' notice, or immediately in the event of a serious breach, unlawful use or discontinuation of the Service. If the Service is discontinued, data export will be facilitated and the proportional amount for paid but unused periods will be refunded.
Data protection
Processing of the Customer's personal data and their account contacts' data is described in the privacy policy, which forms part of these terms.
Guest data. For guest and other third-party data that the Customer enters into the Service or receives through sales channels, the Customer is the controller and the service owner acts as processor on the Customer's behalf. Accordingly, the service owner:
- processes that data solely to provide the Service and following the Customer's instructions;
- ensures the confidentiality of people authorised to process it;
- applies the security measures described in the privacy policy;
- uses the subprocessors listed in the privacy policy (hosting, database, payments, connectivity, messaging and email) and informs the Customer of any changes to that list, to which the Customer may object on justified grounds;
- assists the Customer in responding to data subjects' rights and fulfilling security obligations;
- returns or deletes the data at the end of the relationship, unless legally required to retain it, and makes information needed to demonstrate compliance available to the Customer.
The Customer warrants that they have a lawful basis for processing their guests' data and sharing it with the Service, and that they inform guests in accordance with applicable regulations.
Changes
The service owner may amend these terms to reflect legal, technical or Service changes. Material changes will be communicated at least 15 days in advance by email or through an in-app notice, indicating the effective date.
If you do not accept the changes, you may close your account before that date at no additional cost. Continuing to use the Service after they take effect constitutes acceptance of the new terms. The current version, with its last updated date, is always available on this page.
Governing law and jurisdiction
These terms are governed by the applicable laws of Thailand, without prejudice to any mandatory consumer and user protection rules that may apply in the Customer's country of residence.
For any dispute arising from these terms or use of the Service, the parties submit to the competent courts at the service owner's registered address, unless a mandatory rule provides for a different jurisdiction. Before taking legal action, the parties will attempt to resolve the dispute in good faith by writing to soporte@meo67.com.
If any clause of these terms is declared void, the rest will remain valid and the affected clause will be replaced by another with as similar an effect as possible.
